遭廉署通緝上市公司前主席返港被控串謀詐騙 涉3.3億元欺詐交易
一名被廉署通緝的上市公司前主席，今日(7月29日)返港投案，明日(7月30日)將被帶往法院應訊。被告涉嫌與該上市公司的時任高層人員，藉總值逾3.3億元具欺詐成分的物業交易，抬高上市公司的利潤及資產，串謀詐騙該上市公司股東及香港聯合交易所有限公司(聯交所)。
酈松校，59歲，中新集團(控股)有限公司(中新集團，現稱上海實業城市開發集團有限公司)前主席，被控兩項串謀欺詐罪名，違反普通法。他明日將被帶往東區裁判法院應訊。
廉署早前就涉及中新集團的貪污投訴進行調查，因而揭發上述串謀詐騙罪行。廉署於2011年2月底獲裁判官簽發手令，通緝當時已離港的酈松校及中新集團兩名時任執行董事車漢樹及張曜暉。車漢樹及張曜暉的通緝令仍然生效。
酈松校於2003年10月至2009年8月期間為中新集團主席，車漢樹及張曜暉當時是該上市公司的執行董事。
控罪指酈松校、車漢樹及張曜暉涉嫌於2003年11月至2007年7月期間，與中新集團的公司秘書及財務總監，串謀詐騙中新集團的股東及聯交所。
控罪有關兩項物業買賣協議，涉及中新集團聲稱以2.1億元收購Top Fair Limited (Top Fair)100%股權，以及將中新集團將其附屬公司Noble Time Development Inc. (Noble Time)的全部權益，以1.23億元出售予Northwest Link Investments Limited (Northwest Link)。
涉案人士涉嫌在中新集團發出的公告、通函及年報，訛稱Top Fair及Northwest Link的擁有人均屬獨立人士，與中新集團或其附屬公司之董事、主要行政人員或主要股東等沒有關連；並就該兩項物業買賣協議的代價及溢利製作虛假會計報表，以及隱瞞酈松校是Top Fair及Northwest Link的實益擁有人。
有關人士涉嫌藉上述有欺詐成分的物業交易，導致中新集團股東相信該兩項交易均屬真實，並使聯交所不能履行有關保障中新集團少數股東的職責。
聯交所在廉署調查本案期間提供全面協助。
